What is EFCA?

The Employee Free Choice Act would take away employee’s rights to secret ballot elections. Elections that determine if they want to be represented by a union. With EFCA, if a majority of employees sign union authorization cards, EFCA requires employers to bargain with a union, with no notice of an ongoing union campaign.

Another provision of EFCA would require arbitration of a first contract if the company and the union are unable to reach agreement within 120 days. In such cases, a labor agreement imposed by the arbitrator would bind the parties for two years. This requirement could expose employers to perhaps intolerable obstacles to conducting business successfully.

EFCA Card Tricks provides an entertaining and engrossing description of risks employees take today when they sign union authorization cards, and how much greater their risk is under the EFCA. The message to employees is clear. Signing a union card has always been dangerous. Under EFCA their signatures on union cards could lead to an immediate disaster.
